Terms of Service

Home Brain AI helps homeowners organize a renovation, review contractor quotes and documents, compare contractors, monitor project progress, and ask project-specific questions with the help of AI. We may add, change, suspend, or remove features at any time.

You must be at least 18 years old and able to form a binding contract to use Home Brain AI. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly at support@homebrain.ai if you suspect unauthorized use.

Home Brain AI uses AI to summarize and analyze the information you provide. Its output is informational only and is not legal, financial, engineering, construction, appraisal, or licensing advice, and is not a guarantee about any contractor, quote, cost, timeline, or outcome. AI can be wrong, incomplete, or out of date. Always verify important decisions independently — confirm licenses and insurance with the issuing authority, obtain your own quotes, and consult qualified professionals before signing a contract or spending money. You are solely responsible for the decisions you make.

Home Brain AI is not a party to, and does not participate in, any agreement or relationship between you and any contractor, supplier, or other third party. We do not employ, endorse, recommend, guarantee, insure, or vouch for any contractor, and any scores, comparisons, or analyses are informational estimates based on the information available to us. Any dealings you have with a contractor or other third party — including quality of work, payment, and dispute resolution — are solely between you and that party.

You keep ownership of the photos, videos, documents, notes, and other content you upload (“Your Content”). You grant Home Brain AI LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process Your Content solely to operate and provide the service to you (including transmitting it to our AI and infrastructure providers to generate your analysis). You represent that you have the rights to upload Your Content and that it does not infringe or violate anyone’s rights or any law.

Home Brain AI, including its software, models, prompts, designs, text, and the “Home Brain AI” name and logo, is owned by Home Brain AI LLC and its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the service for your personal, non-commercial home-renovation purposes. You may not copy, modify, reverse-engineer, resell, or create derivative works from the service, or use it to build a competing product, except as permitted by law.

You agree not to: break the law or infringe others’ rights; upload content you don’t have rights to; attempt to access other users’ data or our systems without authorization; interfere with or disrupt the service; scrape, or use bots or automated means to access the service beyond normal use; or misuse the AI features (including attempts to extract training data, prompts, or generate unlawful content). We may investigate, suspend, or terminate accounts that violate this section.

Home Brain AI may offer both free and paid features. If you purchase a paid plan or add-on, the price, billing period, and what’s included will be shown to you at the time of purchase, and you authorize us (through our payment processor) to charge your chosen payment method. Except where required by law or expressly stated, fees are non-refundable. We may change pricing prospectively; changes will not affect a billing period you have already paid for.

To the fullest extent permitted by law, Home Brain AI is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the service or AI output will be accurate, reliable, complete, uninterrupted, secure, or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

To the fullest extent permitted by law, Home Brain AI LLC and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, or for any amounts spent, or decisions made, in reliance on the service or its AI output — even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to the service or these Terms will not exceed the greater of (a) the total amount you paid us for the service in the twelve (12) months before the event giving rise to the claim, or (b) US $100. These limitations are an essential basis of the bargain between you and us. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify, defend, and hold harmless Home Brain AI LLC and its owners, employees, and suppliers from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: Your Content; your use of the service; your violation of these Terms or any law; or your dealings with any contractor or other third party.

You can stop using Home Brain AI and delete your projects or account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the service. Sections that by their nature should survive termination — including Sections 5–6 and 9–14 — will survive.

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules.

Informal resolution. Before filing a claim, you agree to contact us at support@homebrain.ai and try to resolve the dispute informally for at least 30 days.

Binding arbitration. Except for small-claims matters and claims for injunctive relief to protect intellectual property, any dispute arising out of or relating to these Terms or the service will be resolved by final and binding individual arbitration administered under the rules of a recognized arbitration provider, seated in Utah (or by video/telephone where available). The arbitrator decides all issues, except that a court may decide the enforceability of this section.

Class-action waiver. You and Home Brain AI agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. If this waiver is found unenforceable, the arbitration provision (but not the choice-of-law provision) is void as to that dispute. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing us with your account details.

We may update these Terms as the product evolves. If we make material changes, we will update the “last updated” date above and, where appropriate, provide additional notice. Your continued use of Home Brain AI after changes take effect means you accept the updated Terms.

These Terms, together with the Privacy Policy, are the entire agreement between you and Home Brain AI LLC regarding the service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, agency, or employment relationship.
